Terms of Service — Alpintel

1. Acceptance of Terms

By accessing or using Alpintel (alpintel.ai), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use our platform. We may update these Terms from time to time — continued use after changes constitutes acceptance.

2. Description of Service

Alpintel provides a search and intelligence platform for Swiss company data. Our platform allows users to search, filter, and analyse data on over 710,000 Swiss companies, including registered information, estimated figures, and corporate history.

Our data is sourced from publicly available official records, supplemented by statistical models and machine learning estimates.

3. Accounts

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain the security of your password and account credentials
Notify us immediately of any unauthorised access to your account
Accept responsibility for all activity under your account

You must be at least 18 years old to create an account. Accounts are for individual use only and may not be shared.

4. Subscriptions and Payments

4.1 Plans

We offer multiple subscription tiers with varying levels of access. The features, limitations, and pricing of each plan are described on our Pricing page.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All prices are listed in Swiss Francs (CHF) and exclude applicable taxes unless otherwise stated.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.

4.4 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period. If you do not agree with a price change, you may cancel before it takes effect.

5. Acceptable Use

You agree not to:

Scrape, crawl, or systematically download data from our platform by automated means
Access our platform via bots, scripts, or other automated tools without explicit written authorisation
Use our service for spam, harassment, or any illegal purpose
Share your account credentials with others or allow third-party access to your account
Attempt to circumvent access controls, rate limits, or subscription restrictions
Redistribute, resell, or sublicense our data commercially without a separate data licence agreement
Reverse engineer, decompile, or disassemble any part of our platform

Violation of these terms may result in immediate account suspension or termination.

6. Data Accuracy and AI-Generated Estimates

6.1 General

While we strive for accuracy, company data on our platform is derived from public sources and statistical models. We make no warranty regarding the completeness, accuracy, or timeliness of any data. Users should independently verify information before making decisions based on it.

6.2 AI and Machine Learning Estimates

The following data points are generated using statistical models, machine learning algorithms, and AI systems, and are estimates only:

Employee size categories — estimated using proprietary classification models and public data sources
Revenue ranges — estimated from employee size, sector benchmarks, and statistical models
Sector and sub-sector classifications — derived from company descriptions using proprietary models
Subsidiary identification — derived from ownership signals and public registry data
Search query interpretation — natural language queries are interpreted using AI to extract search intent

These estimates may be inaccurate, outdated, or incomplete. They are provided for informational and filtering purposes only and must not be relied upon as the sole basis for financial, legal, investment, hiring, or business decisions.

6.3 No Credit Assessment

Our data and estimates must not be used to produce credit assessments, credit scores, or creditworthiness evaluations of any company or individual. Alpintel is not a credit reporting agency and our estimates do not constitute credit reports.

7. Prohibited Data Uses

7.1 AI and Machine Learning Training

You may not use data obtained from Alpintel to train, fine-tune, or develop machine learning models, artificial intelligence systems, language models, or any automated data processing systems without our express written consent.

7.2 Data Mining and Aggregation

Systematic collection, aggregation, or compilation of our data for the purpose of creating competing products or datasets is prohibited.

7.3 Personal Data Misuse

Company records on our platform include names of board members, directors, and signatories. You may not use this personal data for unsolicited marketing, profiling of individuals, or any purpose unrelated to legitimate business research and analysis.

8. Intellectual Property

The Alpintel platform — including its design, software, search algorithms, classification models, and proprietary data enrichments — is our intellectual property or that of our licensors. All rights are reserved.

Company data is sourced from publicly available information. Our proprietary additions — including estimated revenue, employee classifications, sector assignments, subsidiary flags, and search rankings — are protected.

Your saved lists, notes, and search history belong to you. You may export your lists at any time.

9. API Access

Programmatic access to Alpintel is only permitted through our official API, available to Enterprise plan subscribers. Accessing our platform via unofficial scripts, bots, or automated tools is a violation of these Terms.

API users are subject to additional API Terms of Use, including rate limits, data retention restrictions, and permitted use cases. Misuse of the API may result in immediate revocation of access.

10. Indemnification

You agree to indemnify, defend, and hold harmless Alpintel and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

Your use of the platform in violation of these Terms
Your violation of any applicable law or third-party rights
Any data you submit or transmit through the platform
Your use of company data obtained from our platform

11. Limitation of Liability

To the maximum extent permitted by law:

Alpintel is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy of data
We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for decisions made based on our data, including investment, hiring, acquisition, or business decisions
Our total aggregate liability for any claims arising from or relating to these Terms or your use of the platform is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or CHF 100, whichever is greater

12. Termination

12.1 By You

You may delete your account at any time through your account settings or by contacting us. Upon deletion, your account data, saved lists, and search history will be permanently deleted within 30 days.

12.2 By Us

We may suspend or terminate your account immediately if you violate these Terms. We may also terminate your account with 30 days' notice for any other reason.

12.3 Effect of Termination

Upon termination:

Your right to access the platform ceases immediately (or at the end of your billing period for cancellations)
You must delete any data obtained from our platform that you are not entitled to retain
Sections of these Terms that by their nature should survive termination (including Sections 6, 7, 10, 11, and 13) will continue to apply

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the substantive laws of Switzerland, excluding its conflict of laws provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any disputes arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation for a period of 30 days. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Zurich, Switzerland.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms for specific features (such as API Terms), constitute the entire agreement between you and Alpintel regarding the use of our platform.
